Welcome to GamerGet.Net! We are a platform dedicated to matching gamers with other gamers near them for in-person interactions. These Terms and Conditions ("Terms") govern your access to and use of the GamerGet.Net website, mobile applications (if any), and services (collectively, the "Service").

Please read these Terms carefully before using our Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Acceptance of Terms

By creating an account or using our Service, you confirm that you accept these Terms and that you agree to comply with them. You also acknowledge our Privacy Policy and Safety Guides, which are incorporated by reference into these Terms.

2. Eligibility

You must be at least 18 years of age to create an account on GamerGet.Net and use the Service. By creating an account and using the Service, you represent and warrant that:

• You are at least 18 years old.
• You can form a binding contract with GamerGet.Net.
• You are not a person barred from receiving services under the laws of the United Kingdom or other applicable jurisdictions.
• You will comply with these Terms and all applicable local, national, and international laws, rules, and regulations.
• All information you submit is truthful and accurate, and you will maintain the accuracy of such information.

3. Service Description

GamerGet.Net provides a platform that aims to connect users with other gamers in their vicinity for potential in-person meetups. Matches are suggested based on user-provided information, including gaming preferences and location. Matches may be suggested on a daily or regular basis. GamerGet.Net does not guarantee any number of matches or the compatibility of users.

4. Account Registration & Security

• Account Creation: You may need to register for an account to access certain features of the Service. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
• Account Responsibility: You are responsible for safeguarding your account password and for any activities or actions under your account, whether or not you have authorized such activities or actions. You agree to notify GamerGet.Net immediately of any unauthorized use of your account.
• Account Security: GamerGet.Net cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements.

5. User Conduct & Community Guidelines

You agree to use the Service in a responsible manner and to treat other users with respect. You are solely responsible for your interactions with other users.

• Respectful Interaction: You agree to communicate with other users in a respectful and lawful manner. Harassment, bullying, intimidation, or any form of abusive behavior is strictly prohibited.
• Prohibited Content & Activities: You agree not to post, transmit, or engage in any activity on the Service that:
  • Is illegal or promotes illegal activities.
  • Is fraudulent, false, misleading, or deceptive.
  • Is defamatory, obscene, pornographic, vulgar, or offensive.
  • Promotes discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group.
  • Is violent or threatening or promotes violence or actions that are threatening to any person or entity.
  • Infringes, misappropriates, or violates a third party’s patent, copyright, trademark, trade secret, moral rights, or other intellectual property rights, or rights of publicity or privacy.
  • Involves sending unsolicited communications, promotions, advertising, or spam.
  • Involves the transmission of any viruses, worms, defects, Trojan horses, or any items of a destructive nature.
  • Attempts to solicit personal information (including passwords or financial information) from other users for commercial or unlawful purposes.
  • Involves impersonating another person or entity.
  • Interferes with or disrupts the Service or servers or networks connected to the Service.
  • Uses any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, "data mine," or in any way reproduce or circumvent the navigational structure or presentation of the Service or its contents without our prior written consent.
  • Violates any applicable law or regulation.

GamerGet.Net reserves the right to investigate and take appropriate legal action against anyone who, in GamerGet.Net's sole discretion, violates this provision, including without limitation, removing the offending content from the Service, suspending or terminating the account of such violators, and reporting you to law enforcement authorities.

6. User-Generated Content (UGC)

• Your Ownership and Responsibility: You are solely responsible for all content, including messages, photos, profiles (including your name, image, and likeness), and other materials ("User-Generated Content" or "UGC") that you upload, publish or display (hereinafter, "post") on or through the Service, or transmit to other users. You affirm, represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish UGC you submit.
• License Granted to GamerGet.Net: By posting UGC on or through the Service, you grant GamerGet.Net a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, host, store, reproduce, modify, create derivative works (such as those resulting from translations, adaptations or other changes we make so that your content works better with our Services), communicate, publish, publicly perform, publicly display, and distribute such UGC. This license is for the limited purpose of operating, promoting, and improving the Service, and to develop new ones. This license continues even if you stop using our Service, primarily for the purpose of allowing us to display your content if it was shared with other users who have not deleted it, or for archival and legal purposes.

7. Platform Intellectual Property Rights

The Service and its original content (excluding UGC provided by users), features, and functionality are and will remain the exclusive property of GamerGet.Net and its licensors. The Service is protected by copyright, trademark, and other laws of the United Kingdom and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of GamerGet.Net. You agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works from any GamerGet.Net content.

8. Safety & Interactions with Other Users

You are solely responsible for your interactions and any meetups with other users. GamerGet.Net makes no representations or warranties as to the conduct of users or their compatibility with any current or future users.

• No Background Checks: You understand that GamerGet.Net DOES NOT currently conduct criminal background checks or identity verification checks on its users. GamerGet.Net reserves the right to conduct any criminal background check or other screenings (such as sex offender register searches) at any time and using available public records, to the extent permitted by law.
• Disclaimer of Liability: IN NO EVENT SHALL GAMERGET.NET BE LIABLE FOR ANY DAMAGES WHATSOEVER, WHETHER DIRECT, INDIRECT, GENERAL, SPECIAL, COMPENSATORY, CONSEQUENTIAL, AND/OR INCIDENTAL, ARISING OUT OF OR RELATING TO THE CONDUCT OF YOU OR ANYONE ELSE IN CONNECTION WITH THE USE OF THE SERVICE, INCLUDING WITHOUT LIMITATION, BODILY INJURY, EMOTIONAL DISTRESS, AND/OR ANY OTHER DAMAGES RESULTING FROM COMMUNICATIONS OR MEETINGS WITH OTHER USERS OF THIS SERVICE OR PERSONS YOU MEET THROUGH THIS SERVICE.
• User Precautions: You agree to take all necessary precautions in all interactions with other users, particularly if you decide to communicate off the Service or meet in person. Please refer to our Safety Guides for tips on safe interactions.

9. Reporting Misconduct & Platform Moderation

If you encounter any user violating these Terms or behaving inappropriately, please report them immediately by using the in-platform reporting tools or contacting us at support@gamerget.net. GamerGet.Net reserves the right, but has no obligation, to monitor disputes between you and other users or to terminate or block you and other users for violations of these Terms.

10. Account Suspension & Termination

• Grounds for Suspension/Termination: We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. Such reasons may include:
  • Material or repeated breach of these Terms or our Community Guidelines.
  • Providing false, misleading, or inaccurate information.
  • Conduct that we reasonably believe could cause harm or liability to another user, third party, or us (e.g., hacking, phishing, harassment, spamming, illegal activities).
  • If we are required to do so to comply with a legal requirement or a court order.
• Effect of Termination: If your account is terminated, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
• Appeals Process: If you believe your account has been suspended or terminated in error, you may appeal the decision by contacting us at support@gamerget.net. Please provide your username, the reason for the appeal, and any relevant information or evidence. We will review your appeal and notify you of our decision. We aim to process appeals within a reasonable timeframe. Our decision on appeals is final. We reserve the right to set conditions on appeals (e.g., a time limit for submitting an appeal).

11. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. GAMERGET.NET MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, AND HEREBY DISCLAIMS AND NEGATES ALL OTHER WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF INTELLECTUAL PROPERTY OR OTHER VIOLATION OF RIGHTS. FURTHER, GAMERGET.NET DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS CONCERNING THE ACCURACY, LIKELY RESULTS, OR RELIABILITY OF THE USE OF THE MATERIALS ON ITS WEBSITE OR OTHERWISE RELATING TO SUCH MATERIALS OR ON ANY SITES LINKED TO THIS SITE. WE DO NOT GUARANTEE THAT THE SERVICE WILL FUNCTION WITHOUT INTERRUPTION OR ERRORS IN FUNCTIONING.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GAMERGET.NET, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF DATA OR PROFIT, OR DUE TO BUSINESS INTERRUPTION, OR PERSONAL INJURY OR EMOTIONAL DISTRESS) ARISING OUT OF THE USE OR INABILITY TO USE THE SERVICE, EVEN IF GAMERGET.NET OR AN AUTHORIZED REPRESENTATIVE HAS BEEN NOTIFIED ORALLY OR IN WRITING OF THE POSSIBILITY OF SUCH DAMAGE. OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR ANY INABILITY TO USE ANY PORTION OF THE SERVICE OR OTHERWISE UNDER THESE TERMS, WHETHER IN CONTRACT, TORT, OR OTHERWISE, IS LIMITED TO THE GREATER OF: (A) THE AMOUNT YOU HAVE PAID TO GAMERGET.NET FOR THE SERVICE IN THE 12 MONTHS PRIOR TO THE EVENTS OR CIRCUMSTANCES GIVING RISE TO THE CLAIMS; OR (B) £50.

13. Indemnification

You agree to defend, indemnify, and hold harmless GamerGet.Net, its affiliates, and their respective officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of (a) your use and access of the Service, by you or any person using your account and password; (b) a breach of these Terms, or (c) Content posted on the Service.

14. Third-Party Links & Services

The Service may contain links to third-party websites or services that are not owned or controlled by GamerGet.Net. GamerGet.Net has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that GamerGet.Net shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

15. Modifications to Terms

GamerGet.Net reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

16. Governing Law & Dispute Resolution

• Governing Law: These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
• Dispute Resolution: We encourage you to contact us first at support@gamerget.net if you have a complaint or dispute. We will try to resolve any disputes with you quickly and efficiently. If we cannot resolve a dispute using our internal complaint handling procedure, we will let you know that we cannot settle the dispute with you. We may then explore alternative dispute resolution (ADR) options such as mediation or arbitration. Any agreement to arbitrate must be in writing. You agree that any legal suit, action, or proceeding arising out of or related to these Terms or the Services shall be instituted exclusively in the courts of England and Wales, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

17. General Terms

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.
